平和な街・藤沢を市民の手で 平和無防備条例ニュースＮＯ．６８
２００５年４月１２日 戦争非協力・無防備条例をめざす藤沢の会

■市長は条例案に反対表明。
署名に込めた市民の思いを踏みにじるものです。
赤十字は「無防備宣言は市長でもよい」と言ってるのに、「国」しかできないという間違った理由では、私たちは納得できません。国の言いなりでは、市民の命は守れません。５０数人が参加。満席の傍聴でしたが、残念な結果に参加した市民はがっかりしました。１８日にはもっと多くの市民が集まり、間違った見解を正し条例の制定を実現しようと確認しあいました。
■４／１２臨時議会の報告 １０時～１１時
臨時議会には、始まる前から多くの市民がロビーに集まり、議会の傍聴に臨みました。
議長の開会の挨拶の後に、市側から条例案が読み上げられました。その後、すぐに、山本市長が、「条例への意見」を述べました。
山本市長は、約２万の署名の直接請求について、「国際平和を願う市民の熱い思いとして重く受け止めなければならない」としつつも、主につぎの理由で反対表明しました。
- 無防備条例案の目的は、すでにある「核兵器廃絶条例」の目的（市民の平和で安全な生活の維持向上に資すること）と同じであり新たに必要ない。
- 宣言できる「適当な当局」は、「わが国では国において行なわれるべき。地方公共団体は出来ない」との国の見解がある。
- 国の見解では「特定の都市が宣言しても規定されている宣言に当たらない」と言っている。
- ２、３の理由から無防備宣言しても実質的な効力はなく条例は無理で賛成できない。
■私たちの見解 （要点のみ）
- (1)無防備条例の目的では、「ジュネーブ条約を踏まえ」との文言を書いているのに、その言葉を無視して、「核兵器廃絶条例」の目的と同じとするのはあまりにも強引な解釈です。
条例を比べれは、「市民の平和で安全」を目的とするものでも、一方は、ジュネーブ条約を踏まえた無防備地域宣言をめざすものであり、もう一方は、核兵器廃絶をめざすもので、内容の違いはあきらかです。
- (2)～(4)先に荒川区議会で無防備地域条例の審議が行なわれ、その中で、荒川区側は「赤十字国際委員会の見解として適当な当局とは原則は政府。しかし、現地の地方行政（たとえば市長）でもよいとされている。」と回答しています。つまり国会での国の見解は、当の赤十字によって否定されているのです。
このような間違った国の見解を、反対の理由にするのは、私たちには納得行きません。また、こんないい加減な国の見解に追随している自治体の長としての姿勢にも疑問です。市長は、赤十字の見解を踏まえて宣言できるのです。それをしないのは、市長として市民の安全を守る責任を放棄していると言われても仕方がありません。

（１８日の陳述で、とんでもない市長見解に対してきっちりした意見を述べる予定です。）
