平和な街・藤沢を市民の手で 平和無防備条例ニュースＮＯ．６２
２００５年３月３１日 戦争非協力・無防備条例をめざす藤沢の会
□□□□□□□□□□□□□□□□□□□□□□□□□□
■国民保護法の「訓練」は、日頃から住民を戦争に馴らすため。
有事法があっても国は自治体の自主性を認めており、条例制定は出来る。
●パネラーの発言のポイント
（順次ニュースに継続掲載します。まとめの内容は「会」責任です。）
▼神原元弁護士のお話
- 国民保護法のねらいは、武力攻撃や「テロ」への備えと言いながら、実は平時から住民を戦争の準備に参加させるもの。
- 国民保護法では、今年３月に国民保護モデル計画を発表
（消防庁）、０７年３月までに市町村で基本計画をつくる予定。
市町村は、避難誘導と災害対処にあたる。
- 自治体だけでなく、自治会、町内、学校、病院などを組み込んで、「訓練」に警察・自衛隊ＯＢ・「自警団」の協力を奨励。
- しかし、「計画」や「協議会」は自治体が独自に行なえる。
例えば「（訓練に）自衛隊員を加えるか」という判断は首長（市町村長）ができる。
- したがって政府等の意に沿わない「計画」であっても、国が強制的に是正することは出来ず、この無防備地域条例を「計画」に活用する余地がある。
- 「武力攻撃事態法」では、住民の生命の保護に関して、地方自治体に「その他適切な役割」として独自で実施するものを認めている。保護の方法は多様であり、政府の方針だけが正しい訳でなく、有事法の下でも自治体による平和構築が出来る。

●２９日の議員要請の報告
▼古橋議員（２１社・民ＣＬＵＢ）13:00～14:30 参加者７名・・・賛成の立場で
- 世の中も市議会も以前より右傾化していると感じる。
- 現在平和問題、その他の市民問題は新政会の出方で決まっている。
- 「数の力」で決まるので条例制定はむずかしい。が、議会で否決されても市民の意識啓発、子どもたちの気づきを促すことができる。
- 何らかの成功感は得たい。議会でどこまで自分の言葉で話せるか難しいと思う。
- 国際社会の中で戦争しない関係づくりをして行くのが大事。
▼植木議員（神奈川ネットワーク・藤沢） 14:30～15:00 参加者６名
- 「無防備」の前例（前島・パリ・ローマ）があるのだから、自衛隊は国家を守るが私たちを守らないと言いたい。
- 現状が変わってきたので憲法を変えるのではなく、もとに戻って問い直すのがこれ（条例制定）の主旨だと思うので、きっちりやっていく。
- ９条の理念に戻って守るんだと言いたい。
- 軍事費にお金をかけるのでなく、平和を創るために税金を使ってほしい。これは国も自治体も同じ。
- 国がこうだから条例は作れないというのは逃げ。地方分権から考えて悪いことではない。
